You must be 13 or older. If you are under 18, use Swimtime Pal only with a parent or guardian who agrees to these terms for you.
Workouts, plans and pace targets are general training guidance, not medical advice. Check with a doctor before starting a new exercise program. Swim where a lifeguard is on duty, never swim alone, never practice breath-holding (it can cause shallow water blackout), and stop if you feel pain, dizziness or shortness of breath. Swimming, open-water swimming and training carry real risks, including injury, drowning and death. You choose when, where and how hard you swim, and you are responsible for your own safety and for following lifeguards, posted rules and local conditions. Swimtime Pal does not watch you, cannot see the water and cannot call for help.
The check-in text, overdue alarm, disconnect alert, GPS distance and watch features are reminders and estimates, not a lifeguard, a rescue service or an emergency service. They can fail or be late: a dead or switched-off phone, no signal, a full or muted phone, Android stopping or updating the app, a lost Bluetooth link, or GPS error. Never rely on them instead of a person who knows where you are. In an emergency call 911 or your local emergency number.
To the fullest extent the law allows, you release Plantburgh Products LLC, its owners and its people from, and agree they are not liable for, any injury, illness, death, loss or damage that comes from swimming or training, from using or misusing Swimtime Pal, or from any feature not working, including the safety features above. Where the law does not allow a full release, our total liability is limited to the amount you paid us for Swimtime Pal in the 12 months before the claim. Some places do not allow these limits, so they apply only as far as the law there allows.
Free is free and shows ads. Pro is a monthly Google Play subscription that renews until you cancel in Google Play. Google Play shows the price before you buy. We may change Pro's price or what each plan includes; Google Play tells you before a new price applies to you and, where required, asks you to accept it, and you can cancel before it does. Refunds follow Google Play's policies.
You own your workouts and records. Data on a lost or reset phone cannot be recovered by us, so save a backup file if it matters to you.
Swimtime Pal is provided as is and as available by Plantburgh Products LLC, without warranties of any kind. We work to keep it accurate and working but cannot promise it will be error free or always available.
If we change these terms, Swimtime Pal asks you to agree again before you keep using it. If you do not agree, stop using the app and cancel any subscription in Google Play.
These terms are governed by the laws of Pennsylvania, USA, except where the law where you live says otherwise.
